Public Hearing

Chairman Wright opened the public hearing for an application by Nancy Smith for subdivision approval to subdivide 4.1 acres out of a 520 acre parcel located on McDonald Road.

Attorney David Ames stated that he was able to determine the fall zone of the tower and has made the appropriate changes to the map. The tower height is 165-170 feet and there has been 185 feet allowed for a fall zone on the map.

Attorney David Ames also stated that he received a correspondence from the County Planning Board which stated that the request was reviewed and was technically adequate.

With no questions or comments from the public the public hearing was closed.

Chairman Wright opened the public hearing for an application by Jerry and Rebecca Shoemaker for a special permit to raise 4 chickens in a residential area to produce organic eggs for health reasons at 1723 Sessions Hill Road.

Jerry Shoemaker stated that he and his wife would like to have 4 hens in a fenced in area at their home to produce eggs.

A neighbor residing at 5590 US Route 11 submitted a letter to the planning board stating that she had no objection to Jerry Shoemaker having 4 hens.

With no questions or comments from the public the public hearing was closed.

Regular Meeting

Chairman Wright opened discussion for the application by Nancy Smith for a subdivision of her property on McDonald Road.

Member McMahon made the motion to review the short environmental assessment form which was edited from 2.5 acres to 4.18 acres. Member Crandall seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 6,0,0.

All board members reviewed part 2 of the short environmental assessment form and all questions were answered no. Member McMahon made the motion to declare a negative declaration under SEQR and ask chairman to sign the form. Member Young seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 6,0,0.

Member Young made the motion to approve the subdivision. Member Crandall seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 6,0,0.

The $50.00 application fee had already been submitted and an additional $100 needs to be submitted to the Town Clerk for a $50 public hearing fee and a $50 lot fee.

Jerry Shoemaker stated that the chickens will be completely fenced in. He has two close neighbors, one is Eleanor Bush and she stated she has no problem with him having hens. The other neighbor which is less than 100 feet from his residence is Katelyn Portzline and she submitted a letter stating she has no objection to the chickens.

Member McMahon made the motion to proceed with the short environmental assessment form, declare a negative declaration under SEQR, ask the Chairman to sign the form and approve the special permit for 4 hens. Member Crandall seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 6,0,0.
