Public Hearing

Chairman Lawrence opened the public hearing for an application by Michael Park for an area variance to reduce the front yard setback of the Homer Iron Works office from 50 feet to 41 feet from the center of the highway at 5130 US Route 11.

The applicant stated that the addition would be 41 feet from the edge of the blacktop. He would like to build an addition to his building for office space which would add 20 feet to the front of his existing building.

He stated that this request would be consistent with the setbacks of other businesses in the same area. Morton Building’s office is 41 feet from the highway and Creekside is 38 feet from the highway.

With no further questions or comments from the public the public hearing was closed.

Regular Meeting

Chairman Lawrence opened the regular meeting.

Chairman Lawrence opened discussion for an application by Michael Park for an area variance to reduce the front yard setback of the Homer Iron Works office from 50 feet to 41 feet from the center of the highway at 5130 US Route 11.

Attorney Snyder stated this request is classified under item 16 and is considered a Type 2 action under SEQR therefore no environmental assessment form is needed. He also stated that this is not in the state’s right of way and therefore he would not need state approval for the request.

Chairman Lawrence read the letter received from the Cortland County Planning Department which stated the request has no state or county wide impact and the request was being returned for local determination.

Member Neuman made the motion to grant the area variance to reduce the front yard setback. Member Gilbert seconded the motion. With members is favor saying “aye”, none opposed and Member Miller abstained. The motion was carried 4,0,1.

The meeting was adjourned at 6:45pm.
