Public Hearing

Chairman Wright opened the public hearing for an application by Robert & Nancy Chase to subdivide out a 7.1 acre parcel on the southeast corner of Health Camp Road.

Robert Chase described the intent of consolidating a small lot with his pole barn on it with his house, subdividing off the small tenant house, subdividing 7.1 acres for Tim Deline and remaining lands going to other family members. Both Robert’s lot and the tenant house lot are substandard by Homer Zoning Law and the Case family failed to submit an adequate application for the June Zoning Board of Appeals meeting. They agreed to submit an adequate application to the Homer Town Clerk for the July meeting. They also agreed to obtain a letter from the Cortland County Health Department stating they have no objection to the substandard lot sizes.

Robert Chase represented Tim Deline for the 7.1-acre subdivision request on Health Camp Road. A survey map was presented to the board.

With no questions or comments the public hearing was closed.

Chairman Wright opened the public hearing for an application by Thomas Schenck of 2438 Route 13 to subdivide 58.8 acres into parcels of 39.6 acres and 19.2 acres.

Mr. Schenck explained his intent of the subdivision and stated he would use Route 13 as the subdivision line.

With no questions or comments the public hearing was closed.

Regular Meeting

Chairman Wright opened the meeting for discussion of an application by East River Dairy for site plan approval for a manure storage pit to be located at the southwest corner of the intersection of Forbes Road and Corl Hill Road.

Chairman Wright read the letter that was received by the Cortland County Planning Department which stated the recommend approval with two conditions: 1. The project meet the required storm water erosion prevention plan by D.E.C. and 2. The appropriate screening and fencing be put in place as required by NRCS. Stuart Young agreed to both conditions.

Attorney Snyder stated that due to the agriculture application this project is considered a type 2 action under SEQR and requires no environmental assessment form.

Member McMahon made the motion to approve the site plan. Member May seconded the motion. With members in favor saying “aye”, none opposed and Member Young abstained. The motion was carried 6,0,1.

Member McMahon made the motion to request the Chairman to complete Part 2 of the short environmental assessment form. Member May seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 7,0,0. All questions on the short environmental assessment form were answered no.

Member McMahon made the motion to declare a negative declaration under SEQR, ask the Chairman to sign the assessment and approve the subdivision. Member May seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 7,0,0.

Chairman Wright opened discussion for the wedding and/or events venue. Attorney Snyder stated he is still working on the proposed zoning law to address the wedding and/or events venue and hopes to have something for the board to review at the next meeting.
