Minutes for Wednesday, November 28, 2018 at 7:00pm

Public Hearing

Chairman Wright opened the public hearing for an application by Terry Beard to subdivide out 2.65 acres with the existing residence from the 151-acre parcel at 3036 East River Road.

With no questions or comments the public hearing was closed.

Chairman Wright opened the public hearing for an application by William Gallow to subdivide out 19 acres from an existing 46-acre parcel at 5334 US Route 11.

William Gallow stated that he had an engineer design a septic system due to the proximately to the water. The proposed system design was sent to the county health department but the applicant stated he has not yet received a response from them regarding an approval or recommendation.

There were no questions or comments from the public and the public hearing was closed.

Regular Meeting

Chairman Wright opened the meeting for discussion of an application by Terry Beard to subdivide out 2.65 acres with the existing residence from the 151-acre parcel at 3036 East River Road.

Attorney Snyder stated that the application had been sent to the county and he received correspondence from the planning department stating the request was technically adequate and had no state or county wide impact.

Member McMahon requested that the Chairman complete section 2 of the short environmental assessment form. The board members reviewed the questions and all questions were answered no.

Member McMahon made the motion to declare a negative declaration under SEQR and approve the subdivision. Member Young seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 6,0,0.

The applicant will submit a $150 payment to the Homer Town Clerk which includes a $50 application fee, $50 public hearing fee and $50 lot fee.

Chairman Wright opened discussion for an application by William Gallow to subdivide out 19 acres from an existing 46-acre parcel at 5334 US Route 11.

Member McMahon requested that the Chairman complete section 2 of the short environmental assessment form. The board members reviewed the questions and all questions were answered no.

Member McMahon made the motion to declare a negative declaration under SEQR and approve the subdivision. It was determined that the southern 19 acres of the parcel will be considered the subdivision. Member May seconded the motion. With all members in favor saying “aye”, none opposed and none abstained. The motion was carried unanimous 6,0,0.

The applicant has already submitted payment for the $50 application fee and will submit payment of $100 to the Homer Town Clerk for a $50 public hearing fee and a $50 lot fee.

Chairman Wright opened discussion regarding farm wedding and/or event venues.

CEO Kevin McMahon stated that other municipalities do have specific wedding barn resolutions which can include setbacks requirements and regulations for the building to meet code regulations. He also stated that he has learned NYS Agriculture and Markets does permit such events for any active farm but the building must meet code.

CEO Kevin McMahon recommended the board review other ordinances and resolutions such as the Town of Virgil’s and have further discussion at the next meeting.
